Rules for the purchase and sale of goods in the online store www.neringaart.com

1. General provisions

1.1. These rules for the purchase and sale of goods (hereinafter referred to as the “Rules”) of Neringa Križiūtė, who is self-employed, in the online store www.neringaart.com (hereinafter referred to as the “Rules”), upon acceptance by the Buyer (after familiarizing themselves with the Rules and placing a checkmark next to the statement “I have familiarized myself with the rules of www.neringaart.com and agree to them”), are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions for the purchase and payment for the goods, the procedure for the delivery and return of the goods, the liability of the parties and other provisions related to the purchase and sale of goods in the online store www.neringaart.com.

1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts. The Buyer is informed about any changes, amendments or additions on the www.neringaart.com website and/or by e-mail and, in order to shop in this online store, must accept the amended Rules.

1.3. The online store www.neringaart.com trade is carried out not only in the territory of the Republic of Lithuania, but also in foreign countries.

1.4. The following persons have the right to shop in the www.neringaart.com online store:

1.4.1. capable natural persons, i.e. persons who have reached the age of majority, whose legal capacity is not restricted by court order;

1.4.2. minors from fourteen to eighteen years of age, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;

1.4.3. legal entities;

1.4.4. authorized representatives of all the above-mentioned persons on behalf of the specified persons.

1.5. The Buyer, by accepting the Rules, confirms that, in accordance with clause 1.4 of the Rules, he has the right to purchase goods in the www.neringaart.com online store.

1.6. The Buyer, by confirming the Rules, confirms that he agrees that all information about the goods, before concluding a distance contract, was provided to him in the online store www.neringaart.com in the description of the goods, as well as the instruction (s) of the ordered goods (s) in Lithuanian, at the Seller's discretion and subject to technical capabilities, may be additionally provided in accordance with the procedure provided for in clause 2.2 of the Rules to the e-mail address specified by the Buyer, by sending the Buyer the attached information or an active link to this information in the ordered goods (s).

2. Personal data protection

2.1. The Buyer can order goods in the online store www.neringaart.com in the following way:

2.1.1. by registering in the online store www.neringaart.com, entering his registration name and password;

2.2. The Buyer, when ordering goods in the manner provided for in clause 2.1.1. of the Rules, must indicate his personal data necessary for the proper execution of the order of goods in the relevant information fields provided by the Seller: name, surname, delivery address and country, postal code, telephone number and e-mail address.

2.3. The Buyer, agreeing that his personal data specified in clause 2.2. will be processed in the online store www.neringaart.com for the purposes of analyzing the Seller's activities and direct marketing, shall indicate his agreement with these Rules by checking the box during registration.

2.3.1. By approving these Rules, the Buyer agrees that his personal data specified in clause 2.2 - name, surname, delivery address and country, postal code, telephone number and e-mail address - would be disclosed to the Seller's partners (data processors) providing delivery of goods or other services related to the proper fulfillment of the Buyer's order.

2.4. The Buyer, agreeing that his personal data would be processed for the purpose of selling goods and services in the Seller's online store, also agrees that information messages necessary for the fulfillment of the order for goods would be sent to the e-mail address and telephone number specified by him.

2.5. The Seller confirms that the personal data specified by the Buyer will be processed only for the purposes of selling goods and services in the online store www.neringaart.com and after receiving the Buyer's consent in accordance with the procedure established in clause 2.3, for the purposes of analyzing the Seller's activities and direct marketing (except for cases where the Buyer notifies in accordance with the procedure established in clause 2.10 of the Rules that he does not wish his personal data to be processed for the purpose of direct marketing). The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners providing delivery of goods or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure established by the legal acts of the Republic of Lithuania.

2.6. The Buyer as a data subject has the following rights:

2.6.1. to receive information from the Seller about the processing of his personal data, i.e. to get acquainted with his personal data and how they are processed, to receive information from what sources and what his personal data is collected, for what purpose it is processed, to which data recipients it is provided and has been provided at least over the last 1 (one) year;

2.6.2. to demand correction, destruction of his personal data or suspension, except for storage, of the processing of his personal data, when the data is processed in violation of the provisions of the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other laws;

2.6.3. to object to the processing of his personal data.

2.7. In order to provide the Buyer with full-fledged services of the online store www.neringaart.com, the Seller records information - cookies - on the Buyer's computer (device). The Seller uses the recorded information to identify the Buyer as a previous visitor to the www.neringaart.com online store, to store information about purchases placed in the Buyer's shopping cart, and to collect website traffic statistics. The Buyer has the opportunity to view what information (cookies) the Seller records and may delete some or all of the recorded cookies. The Buyer also has the right to object to the recording and use of information (cookies) on his computer (device), but in this case, certain functions of the www.neringaart.com online store may not be available to him. By accepting the Rules, the Buyer agrees to the recording of information on his computer (device). The Buyer may withdraw this consent at any time by changing the settings of his Internet browser or by contacting the Seller using the contacts specified in the www.neringaart.com online store.

2.8. Any request or instruction related to the processing of personal data must be submitted to the Seller in writing by sending such a request or instruction by e-mail to neringaartshop@gmail.com from the e-mail address specified in clause 2.2 of the Rules. The Seller, upon receipt of such a request or instruction from the Buyer, shall provide a response to the Buyer no later than within 30 (thirty) calendar days.

2.9. If the Buyer does not agree with the Personal Data Protection provisions specified in this section of the Rules, the Buyer loses the right to use the services provided by the online store www.neringaart.com.

3. The moment of conclusion of the purchase and sale agreement

3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased product(s) and formed the shopping cart, clicks on the "Pay" link.

3.2. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the www.neringaart.com online store.

4. Buyer's rights

4.1. The Buyer has the right to purchase goods in the www.neringaart.com online store in accordance with the procedure established by these Rules.

4.2. The Buyer has the right to withdraw from the contract of sale of goods concluded with the www.neringaart.com online store by clearly notifying the Seller in writing (indicating the desired product to be returned and its order number in the message) and, together with the message about the returned product, return the returned product(s) to the Seller no later than within 14 (fourteen) calendar days from the date of delivery/collection of the item(s). The Buyer is informed and agrees that the Seller does not refund the amounts paid by the Buyer until the goods are returned to the Seller. When returning the product(s) to the Seller, the Buyer must comply with all the return conditions set out in clause 11.4 of these Rules.

4.3. The Buyer may exercise the right provided for in clause 4.2 of the Rules only if the goods have not been damaged or have not substantially changed their appearance, and have not been used.

5. Buyer's obligations

5.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.

5.2. The registered Buyer undertakes not to transfer his login details to third parties. If the Buyer loses his login details, he must immediately inform the Seller about this by the means of communication specified in the "Contacts" section.

5.3. If the data provided in the registration form of the registered Buyer changes, he must immediately update them in the "My data" section of his www.neringaart.com account.

5.4. The Buyer, using the www.neringaart.com online store, undertakes to comply with these Rules and not to violate the legal acts of the Republic of Lithuania.

6. Seller's rights

6.1. If the Buyer attempts to undermine the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.

6.2. In the event of important circumstances, the Seller may temporarily or completely terminate the operation of the online store without prior notice to the Buyer. In such a case, all accepted and confirmed orders of the Buyers shall be completed, and new orders shall not be accepted.

6.3. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen the payment methods provided for in paragraphs 8.2.1, 8.2.2 or 8.2.3 of the Rules, does not pay for the goods within 3 (three) business days.

7. Seller's obligations

7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store www.neringaart.com under the conditions established in these Rules and in the online store.

7.2. The Seller undertakes to respect the Buyer's right to privacy to personal information belonging to him, i.e. to process the personal data specified by the Buyer only in accordance with the procedure established in Chapter 2 of the Rules and the legal acts of the Republic of Lithuania.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him.

7.4. The Seller, if unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to refund the money paid to the Buyer within 14 (fourteen) calendar days, if an advance payment was made.

7.5. If the Buyer exercises the right provided for in clause 4.2 of the Rules, the Seller undertakes to refund the money paid to the Buyer for the goods within 14 (fourteen) calendar days from the date of receipt of the returned goods.

8. Prices of goods, payment procedure and terms

8.1. Prices of goods in the online store and in the formed order are indicated in euros including VAT, if the Seller is a VAT payer.

8.2. The Buyer pays for the goods in one of the following ways:

8.2.1. Payment using electronic banking is an advance payment using the electronic banking system used by the Buyer. The Buyer transfers the money to the www.neringaart.com online store account in the relevant bank of his choice. Responsibility for data security in this case lies with the relevant bank, since all monetary transactions take place in the bank's electronic banking system.

8.2.2. Payment by bank transfer is an advance payment when the Buyer, having printed the order and gone to the nearest bank branch, transfers the money to the www.neringaart.com bank account;

8.2.3. Payment via PayPal is an advance payment using the electronic PayPal payment system used by the Buyer.

8.3. When paying by the payment methods provided for in paragraphs 8.2.1, 8.2.2, 8.2.3, the Buyer undertakes to pay immediately.

8.4. By confirming the Rules, the Buyer agrees that the purchase documents for the goods - invoices or VAT invoices (if the Seller is a VAT payer), which are also warranty coupons for the goods, would be submitted to him electronically to the email address specified in the Buyer's registration form.

8.5. After the Seller has confirmed the order, the price of the Goods indicated in the online store may be changed only when it has changed due to a technical error in the information systems or other objective reasons beyond the Seller's control. If in such a case the Buyer does not agree to purchase the goods at the new price, the Buyer may cancel the order by informing the Seller thereof. If the order is canceled in accordance with the procedure provided for in this clause, the Buyer shall be refunded all amounts paid by him.

8.6. When the order is canceled before the conclusion of the Purchase and Sale Agreement, the losses incurred due to the cancellation of the order shall not be compensated. When the order is canceled after the conclusion of the Purchase and Sale Agreement, the Seller may compensate the Buyer for the direct losses incurred and justified and proven, but not more than the price of the goods specified in the canceled order.

9. Delivery of goods

9.1. When ordering goods, the Buyer must be aware that there are several methods of delivery of goods. The methods of delivery of goods are: parcel delivery service provided by AB "Lietuvos paštas" (Lithuania post).

9.2. Before collecting the goods by any method of delivery, the Buyer must have paid the delivery fee, if it was not included in the price of the goods.

9.3. The goods may be collected only by the recipient specified in the order or by his authorized person.

10. Quality guarantee and shelf life of goods

10.1. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.

11. Retail rules

11.1. Defects in the sold goods shall be eliminated, poor-quality goods shall be replaced, and returned in accordance with the Civil Code of the Republic of Lithuania and the “Retail Trade Rules” approved by the resolution of the Government of the Republic of Lithuania.

11.2. In order to return the goods(s) in the cases specified in clause 11.1 of the Rules, the Buyer shall submit to the Seller a written clear statement setting out his/her decision to withdraw from the contract, and together with the statement, submit to the Seller the returned goods(s).

11.3. In order to exercise his/her right to withdraw from the distance contract without giving a reason, except for the exceptions provided for in paragraph 2 of Article 6.228-10 of the Civil Code of the Republic of Lithuania, the Buyer may do so within 14 (fourteen) calendar days from the date of delivery of the goods to him/her, informing the Seller thereof in accordance with the procedure provided for in clause 4.2 of the Rules.

11.4. When returning the product(s), the Buyer must comply with the following conditions:

11.4.1. the returned product must be in its original, neat packaging;

11.4.2. the product must not be damaged by the Buyer;

11.4.3. the product must be unused and not have lost its commercial appearance (labels not damaged, protective film not torn, etc.);

11.4.4. the returned product must be in the same configuration as the Buyer received it;

11.4.5. Underwear, socks, nightwear, perfumes - non-returnable goods.

11.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the procedure for returning goods established in this article.

11.6. Money for the returned goods is in all cases transferred by payment order and only to the payer's bank account.

11.7. The Buyer shall be refunded the price of the goods and the delivery costs (the costs incurred by the Buyer for returning the goods are not refundable).

11.8. The costs of returning the goods(s) shall be borne by the Buyer himself (the costs incurred by the Buyer for returning the goods are not refundable).

12. Liability

12.1. The Buyer is fully responsible for the accuracy of the personal data provided by him. If the Buyer does not provide accurate personal data, the Seller is not liable for the consequences arising from this and the Seller acquires the right to claim compensation for all direct losses incurred from the Buyer.

12.2. The Buyer is responsible for the actions performed using this online store.

12.3. The registered Buyer is responsible for the transfer of his login data to third parties. If the services provided by www.neringaart.com are used by a third person who has logged in to the online store using the Buyer's login data, the Seller considers this person, on whose behalf the www.neringaart.com online store is logged in, to be the Buyer.

12.4. The Seller is exempted from any liability in cases where losses arise due to the fact that the Buyer, disregarding the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

12.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.

13. Final provisions

13.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

13.2. The law of the Republic of Lithuania applies to relations arising on the basis of these Rules.

13.3. All disagreements arising from the implementation of these Rules shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

13.4. "The Buyer - consumer must first submit a request and (or) complaint regarding the activities and services of the online store in writing to the Seller and indicate his requirements. If he does not agree with the Seller's response, the Buyer may apply to the State Consumer Rights Protection Service."
